Cancellation guidance
An effective cancellation begins with a careful review of the contract, the applicable deadlines and the correct route of delivery.
This page works through the points that can be settled before a cancellation letter is sent. It does not replace a review of your individual case, but it shows which details carry a letter and where disputes typically arise.
What should be checked before cancelling?
Follow-up questions tend to concern the details in a cancellation rather than its wording. These eight points can be settled from the contract and the most recent invoice.
Contracting party
The company on the invoice is not always the legal contracting party. What matters is the company named in the contract, not the brand.
Contract or customer number
Without a clear reference a cancellation cannot be matched. Where several contracts exist with the same provider, the letter should say which one is meant.
Minimum term
Start date and minimum term come from the original contract, not from the provider's current website. Later amendments may have changed both.
Notice period
The notice period is a separate figure from the term. Blanket assumptions such as “always three months” do not hold across contract types.
Automatic renewal
Check whether and for how long the contract renews without notice, and by when a declaration would have to arrive to prevent it.
Special termination rights
Price increases, a move or a change in service may trigger a separate right to terminate. The conditions and deadlines differ by contract type.
Required form
Text form, written form and a dedicated cancellation button are not the same thing. German law provides for a cancellation button for certain consumer contracts concluded online.
Delivery and evidence
What usually matters is that the declaration reaches the recipient. Plan the route that will allow you to show this from the outset.
Common cancellations
For the following continuing obligations the underlying questions are the same; the relevant details differ.
Mobile phone
The number, the start date and whether you want to keep the number all belong in the same letter.
Gym
Often long minimum terms and renewal clauses. Moving gyms or falling ill does not automatically create a special right to terminate.
Insurance
The policy number and the main renewal date govern. A premium increase may create a separate right to terminate.
Subscription
Digital subscriptions often renew monthly. Check whether the cancellation was confirmed in the account and keep that confirmation.
Membership
For associations the articles govern, and they may depart from the statutory default.
Service contract
Name the specific service being ended where several services are taken from the same provider.
Other continuing obligations
Energy, newspapers and maintenance contracts follow the same structure: party, reference, notice period, form, delivery.
Withdrawal or cancellation?
The two are often used interchangeably, yet they serve different purposes. Cancellation ends an ongoing contract for the future. A statutory right of withdrawal can instead undo the binding effect of the contract itself — but it exists only under certain conditions and not for every contract. Section 355 of the German Civil Code governs the exercise of the consumer right of withdrawal; it does not create a general right of return for every purchase. Whether a right of withdrawal exists, when the period starts and whether an exception applies depends on the type of contract and the circumstances in which it was concluded. In doubtful or already disputed cases the route should be chosen by its conditions, not by everyday usage.
Documenting a cancellation properly
Sending a letter and being able to show that it arrived are two different things. Under section 130 of the German Civil Code a declaration made to an absent party generally takes effect on receipt, and the date on your own printout does not answer that question. Keep the text actually sent, the full recipient details and the proof of dispatch together — including delivery and error messages for electronic routes. Compare any confirmation you receive against your letter and the expected end date. If no confirmation arrives, or the date differs, clarify the discrepancy promptly and record your follow-up with its date and content.

When is an individual review worthwhile?
A general template reaches its limit as soon as the other side objects or the deadline position is unclear. In these situations a review of the actual matter is regularly advisable:
- The cancellation is rejected.
- The notice period is disputed between the parties.
- The contract was renewed automatically.
- A special right of termination is being relied on.
- Payments are still being debited.
- Receipt of the cancellation is denied.
The general information and templates on this page do not replace an individual legal assessment. In disputed or complex cases the specific contract should be assessed on its own facts.
